Obtain a valid NHDES Asbestos Abatement Entity License before your company starts any asbestos project in New Hampshire — operating without one violates RSA 141-E and Env-A 1800, triggering stop-work orders, fines, and potential criminal charges.


Any Company Doing Asbestos Abatement Needs This License


The New Hampshire Department of Environmental Services (NHDES) requires an Asbestos Abatement Entity License for any business performing major asbestos abatement — stripping, encapsulating, or enclosing asbestos-containing materials (ACM) in public or private buildings, structures, and equipment statewide. Individual workers still need their own NHDES certifications; the entity license does not substitute for them.


Apply through the NHDES licensing page at des.nh.gov/waste/asbestos/license-and-certifications. As of the most recent NHDES fee schedule, the application fee is $1,000 and the annual renewal fee is $750; verify current amounts directly with NHDES before submitting, as fees are subject to revision.


Annual Renewal — 12-Month License Term Under RSA 141-E:10


RSA 141-E:10 sets entity license validity at exactly 12 months from the date of issuance — plan for annual renewal. RSA 541-A:29 gives NHDES up to 60 days to act on a complete application, so submit your renewal well before expiration to avoid any gap in authorization.


Every On-Site Worker Needs Individual NHDES Certification


RSA 141-E:11 requires every individual performing asbestos abatement to hold a written NHDES certification, which must be readily available at the worksite for inspection. Individual certifications are also valid for 12 months. Separate pathways exist for abatement workers, supervisors, inspectors, and risk assessors — the entity license does not cover unlicensed individuals doing the work.


Asbestos Project Notification Fees Increased in 2026


NHDES revised project notification fees effective 2026 under Env-A 1800: Type A projects now carry a $575 fee (rising to $725 in 2027), Type B $450 ($600 in 2027), and Type C $100 ($125 in 2027). These per-project notification fees are billed at project start and are separate from the annual entity license fees.


Operating Without This License Violates RSA 141-E


Performing asbestos abatement without a valid NHDES entity license violates RSA 141-E and Env-A 1800. Enforcement includes significant fines, stop-work orders, and potential criminal charges. NHDES actively investigates complaints and pursues unlicensed operators to protect public health.
