Delaware General Contractor Business License
The Delaware Division of Revenue requires all contractors performing construction work in the state to register and obtain a business license under Title 30, Chapter 25 of the Delaware Code. This applies to any person or firm furnishing labor, materials, or both for construction, alteration, or repair of buildings, roads, bridges, or other structures.
What This License Authorizes
The general contractor business license authorizes the holder to perform construction contracting work throughout the state of Delaware. Contractors bidding on projects exceeding $50,000 must initiate the license application before submitting their bid.
Registration Requirements
- Department of Labor Certification: Must comply with Delaware Department of Labor registration requirements
- Workers' Compensation Insurance: Proof of coverage required at time of application
- Gross Receipts Tax: Contractors pay an additional 0.6472% on monthly aggregate gross receipts (after $100,000 monthly deduction per enterprise)

- Late Penalty: 10% per month past due, capped at 50% ($37.50 maximum late fee)

Consequences of Operating Without a License
Contractors operating without a valid license face a civil penalty of up to $10,000 for each occurrence, assessed by the Secretary of Finance. Willful violations constitute a misdemeanor with fines up to $3,000 and/or imprisonment up to 6 months. Entities awarding contracts must report nonresident contractors to the Department of Finance within 10 days.
