South Dakota Contractor's Excise Tax License


The South Dakota Department of Revenue requires all contractors who enter into contracts for construction services to obtain a Contractor's Excise Tax license. This is the closest equivalent to a general contractor registration in South Dakota, as the state does not require a state-level general contractor license.


What This License Authorizes


The Contractor's Excise Tax license authorizes the holder to legally perform construction services in South Dakota and collect and remit the required excise tax. Any person entering into a contract for construction, building, installation, or repair of a fixture to real property must hold this license.


Who Needs This License


All contractors performing construction services in South Dakota, including general contractors, subcontractors, and specialty trade contractors. This applies to new construction, remodeling, repair, and renovation work on real property.


Tax Obligations


  • Excise Tax Rate: 2% of gross receipts from construction projects
  • Filing: Returns must be filed and tax remitted on a regular schedule determined by the Department of Revenue
  • Electronic Filing: Available through the Department's online portal

  • No Renewal Fee: The license does not expire and does not require periodic renewal

Application Process


Applications are submitted online through the South Dakota Department of Revenue's tax license application system. A license card will be issued once approved. Contractors can sign up for electronic filing at the same time.


Consequences of Operating Without a License


Operating without a contractor's excise tax license carries penalties of up to $1,000 fine and/or one year in jail for the initial offense. Continuing to operate after receiving notification from the Department of Revenue that a license is required is a Class 6 felony, punishable by up to $4,000 fine and/or two years imprisonment.
